DS+ Terms of Service

Please read the Terms and Conditions provided below carefully. These terms set forth the legally binding terms and conditions for the use of DS+ Internet Services (the “Services”) and shall govern your use of the Services for the period which you are subscribed. Kindly note that these terms may change from time to time and shall apply in respect of all Services.

1. Definitions

In these Terms, unless the context otherwise provides:

  • “Agreement” means these Terms and Conditions as read, understood, and accepted by the Customer.
  • “Channel Partner” means a company that partners with DS+ to sell the Services.
  • “Customer” means any person or organization who has agreed to utilize any DS+ Services.
  • “Government Authority” means any national, regional, or local government, regulatory body, or law enforcement agency within the Republic of Ghana.
  • “Services” means the provision of internet to the Customer and includes all service packages, plans, and offers introduced by DS+ from time to time.

2. Service Scope

2.1. DS+ shall provide Internet Services to the Customer for the duration of the paid subscription.

2.2. DS+ reserves the right to withdraw, amend, or modify account-related codes, IDs, or passwords assigned to the Customer at any time without assigning a reason.

2.3. The Services and all access parameters (User IDs, passwords, etc.) remain the exclusive property of DS+. The right to use these ceases immediately upon the expiration of the Agreement.

2.4. DS+ reserves the right to modify or delete Service plans, schemes, or offers at any time, provided reasonable notice is given to the User thereafter.

2.5. DS+ is not liable for any loss or damage arising from transactions the Customer enters into with third parties using the Services.

2.6. Neither DS+ nor its Channel Partners warrant that the Services will be uninterrupted or error-free, or that materials accessible via the Service are free of viruses or harmful components.

2.7. The Customer is responsible for ensuring that competent persons install the hardware or software needed for the Service. DS+ shall not be responsible for hardware/software compatibility issues at the customer premises.

2.8. DS+ accepts no responsibility for the content of external websites or organizations accessed through the Services.

2.9. DS+ reserves the right to block access to information that is not permissible under the laws of the Republic of Ghana.

2.10. Billing Cycle: Our service day commences at 00:00:00 and ends at 23:59:59. Internet access expires at 00:00:00 on the expiration day.

2.11. Equipment: Devices provided belong to DS+. They will be withdrawn if an account remains expired for 90 days. The Customer is responsible for the safety of the device. If damaged, the Customer assumes full financial responsibility for replacement at current market rates.

2.12. Relocation: Relocation of a fixed CPE (Customer Premises Equipment) is subject to additional costs and must be within a DS+ coverage area.

2.13. Refunds: No refunds will be issued for setup fees or subscriptions once installation is complete and the internet connection has been confirmed as working.

2.14. Auto-Billing: If a company device is not retrieved following service termination, the Customer’s registered card will be charged within 7 days. DS+ reserves the right to take legal action if the charge fails.

2.15. Network Management: DS+ reserves the right to monitor traffic patterns for security and to restrict bandwidth or access to specific sites to ensure fair usage and network stability.

2.16. Prohibited Activities: Customers shall not send “Spam” or unwanted commercial messages. Violation may lead to immediate account termination and reporting to authorities.

2.17. Indemnity: The Customer agrees to indemnify and hold DS+ harmless from any claims, damages, or losses (including copyright infringement or defamation) arising from their use of the service.

3. Privacy

3.1. DS+ may provide Customer information to Government Authorities to detect/prevent crime or protect national security, in line with the laws of Ghana.

4. Force Majeure

DS+ is not liable for failure to perform obligations resulting from acts of God (fire, flood, earthquake), war, terrorism, government sanctions, labor disputes, or failure of third-party electricity/telecommunications providers.

5. Suspension of Service

DS+ may suspend Services without notice if:

  • Payments are not realized due to Customer fault.
  • The Customer provides false or misleading information.
  • The Customer violates these Terms and Conditions.
  • Necessary maintenance, repairs, or system improvements are required.

6. Disclaimer

While DS+ strives for high service quality, the network is interconnected with links provided by other entities. DS+ is not responsible for interruptions caused by defects in these third-party links or factors beyond its reasonable control.

7. Disputes

Any dispute arising from these terms shall be adjudicated by a competent Court in Accra, and the governing law shall be the Laws of the Republic of Ghana.
